Direct response

A visa and a residence permit are two distinct stages

The temporary resident visa for Mexico allows you to apply for entry to stay in the country for more than 180 days and up to four years. The visa is processed at a Mexican consular office in accordance with the applicable criteria. After entering the country, you must apply to the National Institute of Migration to exchange the visa for a resident card within the following 30 calendar days.

Choose Before Scheduling

Under what circumstances can a request be made?

There is no one-size-fits-all process. Each application pathway follows a different evidentiary framework, and the consular office may issue specific operational requirements.

Via What Is Analyzed Critical point
Financial Solvency Income, employment, pension, or bank balances, in accordance with the criteria published by the consular office. Period, ownership, currency, and method of crediting the funds.
Family unit A relationship with a Mexican national or with a specific foreign national who is a resident or visa holder. Type of legal relationship, service of process, and international validity of the records.
Invitation Participation in an unpaid activity sponsored by an institution. The letter of guarantee, the purpose of the activity, and the institution's capacity.
Real estate Ownership and Value of Real Estate in Mexico Under the Applicable Regulatory Threshold. Direct ownership, title, and creditable value.
Investor Business involvement, assets, or actual economic activity in Mexico. The evidence must correspond to the legal presumption, not merely to an incorporated company.
Job Opening Visa authorization previously requested by the employer from the INM. This process begins in Mexico; the consular interview takes place after authorization is granted.

The SRE also covers specific cases, including scientific research and certain international instruments. The applicable procedure depends on the facts and documents of each case.

Consulate → Entry → INM

The entire process, in the correct order

The visa allows you to report to the port of entry. The card issued by the INM is the document that proves residency in Mexico.

“A visa in your passport does not replace your resident card.”
  1. Specify the route and the consular office

Identify the applicable provision and review the rules published by the selected consulate. If you are not a national of the country where you are applying, you will generally need to provide proof of legal status.

  2. Submit your application and attend the interview

The application is personal. The consular office receives the documents and biometric data, collects the application fee, and conducts the interview.

  3. Obtain a visa and plan your entry

The temporary resident visa is issued with a validity period of 180 calendar days and a single entry to apply for residency status.

  4. Submit documentation for redemption

Entry in accordance with the visa must be documented at immigration. It is advisable to review the entry record immediately and address any inconsistencies.

  5. Apply for the card at the INM

The exchange must be submitted within 30 calendar days of the deposit at the branch corresponding to your address in Mexico.

30

calendar days after admission

Critical deadline

What happens if you don't request the exchange on time?

The regulations require that you apply for the card within the specified time frame. If the deadline passes, you should not assume that the visa can be used again or that it will be automatically renewed.

Immigration status and available options must be reviewed based on the date of entry, the admission record, and current documentation. MIGRALAW can assess the situation before taking any further action.

Documentary Prevention

Risks that must be identified before filing

An abundance of documentation does not make up for a poorly chosen course of action. The review must link each document to the legal issue at hand and to the practices of the office that will handle the case.

  • Bank statements without a clear account holder, a complete time period, or an accepted method of validation.

  • An invitation letter that actually describes paid work in Mexico.

  • Foreign documents lacking the required international certification or translation.

  • Real estate, an investment, or a business interest that does not meet the applicable threshold.

  • Applying in another country without being able to prove the required legal stay.

  • Interview responses that contradict the duration, nature, or source of income.

  • Entry documented in a manner inconsistent with the visa issued for exchange purposes.

  • Payment, format, mailing address, or submission of the exchange after the legal deadline.

Legal Basis and Enforcement

One Strategy for Two Authorities

MIGRALAW coordinates the case strategy prior to the consular appointment and maintains the same documentation process for entry into and exchange in Mexico.

Experience matters because even a technically complete application may be rejected if the circumstances, the office, or the sequence do not correspond to the applicant's actual situation.

These answers provide general guidance. The applicable procedure and its requirements should be reviewed in light of the specific facts of the case.

It allows you to stay for more than 180 days and up to four years. The consular visa is used to enter the country and apply for the card; the specific validity period of the immigration document depends on the stage of the process and the applicable circumstances.

The federal fee for a consular visa is 56 U.S. dollars. Processing the visa through the INM incurs an additional fee; the current official fee schedule lists 5,570 Mexican pesos for a one-year temporary resident visa. These government fees are separate from MIGRALAW’s fees.

The standard process for obtaining temporary residency based on financial solvency begins at a Mexican consulate abroad. There are procedures within Mexico for specific situations, so one should not assume that all cases require the same process.

It depends on the authorized status and how the compensation is received. When there is a job offer in Mexico, the employer must first apply for a visa authorization from the INM. Other scenarios may require additional authorization.

Not necessarily. The SRE states that it can be applied for at a Mexican consular office; if you are not a national of the country where you are submitting the application, you must provide proof of legal status. Each office has its own appointment system and operational requirements.

No. The relationship may qualify as a basis for admission per family unit, but it must be substantiated with valid documents and comply with the applicable procedure. The requirements for apostille, legalization, and translation depend on the document, the country of issuance, and the receiving authority.

You should review the hospitalization record immediately and seek guidance before submitting the exchange request. The outcome and any possible correction depend on how the admission was documented; you should not automatically assume that the process is a lost cause.
